Lecture - The Taxation of IP: From Tax Credit to IP Box/Patent Box

In March 2017, ARCIALA celebrates the “Greater China IP Month,” and is proud to host Professor Jerry Fong as Visiting Professor during the period 27-31 March 2017. Professor Fong will deliver two public lectures during his visit on the theme “Intellectual Property Transactions: From Taxation to M&As”. The first lecture will be delivered on 28 March 2017. 

 

Synopsis

As the revenues generated from IP continue to grow globally, legal and policy issues surrounding the taxation of IP also increase. IP, with its intangible nature, is highly mobile. Therefore government planning can attract, or divert, IP-related revenues. To attract more IP revenues, or at least to ward off the erosion of the tax base, more than a dozen EU countries, such as U.K., the Netherland and France, have adopted the IP Box/Patent Box regimes. In this context, IP taxation has become a new field in which nations compete. This lecture will first introduce the traditional IP taxation regimes, such as tax credit, then focus on the IP Box/Patent Box regimes adopted by the EU countries and the OECD Base Erosion and Profit Shifting (BEPS) Project. Finally, this lecture will explore the IP taxation policies that Asian countries can adopt and discuss how a balanced and attractive IP taxation regime can be achieved by these countries.  

 

Speaker

Professor Fong specializes in corporate law, securities regulation, intellectual property law, intellectual property management and licensing law. He currently holds a joint-appointment as Professor at the College of Law and the College of Business at National ChengChi University (NCCU) in Taiwan. He is also in charge of the Biopharmaceutical Section of NCCU EMBA program. Before joining NCCU, Professor Fong taught at Chung Yuan Christian University (CYCU) and was the Head of Department of Financial & Economic Law. In 2005, he received a Fulbright Scholarship and visited the University of Washington Law School. In 2011, he was a visiting scholar at the George Washington University Law School. Professor Fong is a prolific writer. He has authored more than a dozen books, over 200 academic articles, and over 400 non-academic articles.
